Asset Forfeitures

An asset forfeiture is confiscation by a state or federal agency, such as the FBI, DEA, ATF, ICE, IRS, Secret Service, Department of Homeland Security, state and local law enforcement, and Department of Justice, of property alleged to be proceeds or tools of a crime. For example, a vehicle used to unlawfully traffic firearms or controlled substances may be forfeited because it was a tool of the crime used in the transport of firearms. Both federal and Florida law include heavy fines and severe criminal penalties for the crimes associated with asset forfeitures, including potential mandatory/minimum sentences of up to 25 years and maximum potential sentences of up to life.
